Billions of dollars for coastal restoration and economic development throughout the Gulf Coast, including Lafourche and Terrebonne, are at stake as a transportation bill winds through Congress.
</br></br>
The U.S. Senate passed a transportation bill Wednesday with an amendment, called the Restore Act, that would divert billions of dollars in fines from the BP oil spill toward the Gulf Coast states most impacted.
</br></br>
“It’s essential that any opportunity we have to restore our coast and protect our wetlands be taken advantage of,” said Terrebonne Parish President Michel Claudet. “It’s so significant that it surpasses local and state funding sources.”
</br></br>
Under the Clean Water Act, BP can be fined from $1,000 to $4,300 per barrel leaked after the deadly explosion and sinking of the Deepwater Horizon oil rig. The first $2.7 billion will go into the Oil Spill Liability Trust Fund, which is used for cleanup costs, and additional money will go to the federal treasury unless Congress decides differently.
</br></br>
The Restore Act would:
</br></br>
- Dedicate 80 percent of Clean Water Act penalties charged to BP to the restoration and economic development of the Gulf Coast.
</br></br>
- Provide resources and flexibility to Gulf Coast states to start economic and ecological recovery immediately.
</br></br>
- Establish a Gulf Coast Ecosystem Restoration Council and a comprehensive plan for the Gulf Coast focused on ecosystem and coastal restoration.
</br></br>
- Establish a long-term Science and Fisheries Endowment and Gulf Coast Centers for Excellence.
</br></br>
Aaron Viles, a spokesman for the Gulf Restoration Network, said Clean Water Act fines could total as much as $20 billion depending on which estimates of oil spilled into the Gulf are used.
</br></br>
It’s critical that the U.S. Department of Justice collect a large settlement from BP or that the oil company is taken to court and “held accountable,” he said.
</br></br>
“The Restore Act is really critical in jump-starting the Gulf restoration that we’ve been talking about for so long,” he said.
</br></br>
Lafourche Parish President Charlotte Randolph said the bill is critical for the region.
</br></br>
Among the projects that could benefit is the long-pursued effort to upgrade La. 1, which is sinking and regularly floods in heavy rains, she said. With more than $1 billion in improvements planned to replace the road with an elevated highway from U.S. 90 to Port Fourchon, parish and state officials have said outside help is needed.
</br></br>
“We will ask for a component that addresses La. 1, whether it’s protection for it or construction of it,” she said.
</br></br>
All eyes, she said, are now turned to the U.S. House. Reps. Jeff Landry, Houma-Thibodaux’s Republican congressman, will be among a bipartisan group of Gulf Coast lawmakers pushing to secure the needed votes.
</br></br>
“Jeff will continue to fight like hell to bring hurricane protection and coastal restoration to the people of south Louisiana,” said Millard Mulé, Landry’s spokesman.
</br></br>
The House already passed its own version of the Restore Act earlier this year. That measure was introduced by Rep. Steve Scalise, R-Metairie, and co-sponsored by Rep. Cedric Richmond, D-New Orleans and Landry. Like the Senate bill, the amendment is attached to a transportation bill the House passed last year.
</br></br>
But Speaker John Boehner, R-Ohio, has been unable to gather the votes necessary to pass the House version of that transportation bill, which includes measures to increase oil exploration that are opposed by Democrats.
</br></br>
The House can now take an up or down vote on the Senate’s bill or start entirely from scratch and create a new bill.
</br></br>
If the House starts from scratch and creates a new bill, U.S. Sen. David Vitter, R-La., said he would be on the conference committee to reconcile the Senate bill with the House bill to ensure the Restore Act is included.
</br></br>
Mulé said it’s unclear when the House would take action on the legislation.
</br></br>

RIO DE JANEIRO (Reuters) - Chevron (CVX.N: Quote, Profile, Research, Stock Buzz) filed to temporarily halt production operations in Brazil on Thursday after it detected a "small new seep" of oil in the same offshore field where it suffered a high-profile leak in November.
</br></br>
The U.S. oil company said it was taking the step as a precautionary measure to study its "reservoir management plans" in Brazil, where it has spent over $2 billion developing the largest foreign-run oil field. If approved by Brazilian regulators, the suspension will shut down a field with the capacity to produce 80,000 barrels a day, more than 3 percent of Brazil's oil output.
</br></br>
Chevron's previous spill leaked 2,400 to 3,000 barrels from sea-floor cracks and resulted in an $11 billion civil lawsuit, the largest environmental damages case in Brazil's history, even though the total amount of oil was less than 0.1 percent of the BP (BP.L: Quote, Profile, Research, Stock Buzz) spill in 2010 in the Gulf of Mexico.
</br></br>
Chevron said there is no evidence yet that the two spills in Brazil are related or that it caused the latest leak.
"The suspension of production is designed to let us analyze scientifically what caused this," Rafael Jaen Williamson, Chevron's director of corporate affairs in Brazil, said at a news conference in Rio de Janeiro. He added that he hoped the suspension would only last "a matter of months" and that the decision does not alter Chevron's investment plans in Brazil.
</br></br>
The move to suspend operations at the so-called Frade field, which is currently producing about 61,500 barrels a day, raises questions about the safety and speed with which Brazil can develop giant new offshore oil resources.
The Campos basin, where Frade is located, and the neighboring Santos basin contain an estimated 100 billion barrels of oil, enough to provide all current U.S. needs for more than 14 years.
</br></br>
Brazil hopes the region, the world's most promising offshore frontier, will help it produce more than 7 million barrels a day of oil by 2020, passing the United States to be the No. 3 oil producer after Russia and Saudi Arabia.
Chevron's troubles in Brazil could force it to rethink its Latin American strategies. A shortage of trained workers, engineers and equipment have driven up costs in Brazil, and Chevron faces an $18 billion environmental verdict in Ecuador.
</br></br>
The request to suspend output came on the same day that Brazilian oil regulator ANP said it had notified Chevron that it would be fined an undisclosed amount for failing to prevent seepage at the site. Chevron is already facing fines of up to $121 million for the November spill and has had its drilling license suspended in Brazil.
Chevron said the decision to suspend production at Frade was supported by its partners in the field: Brazilian state oil company Petrobras (PETR4.SA: Quote, Profile, Research, Stock Buzz) and Frade Japan, which is owned by Japan's Inpex (1605.T: Quote, Profile, Research, Stock Buzz), Japanese trading house Sojitz (2768.T: Quote, Profile, Research, Stock Buzz) and Japanese state oil and metals group JOGMEC.
</br></br>
Chevron owns 52 percent of Frade and operates the field. Petrobras owns 30 percent and Frade Japan, 18 percent.
Chevron shares, which were already trading down for the second straight day before the news of the new Brazil leak, slid further. The shares fell as much as 1.1 percent to $109.47, with trading volumes reaching the highest level in three weeks.
</br></br>
They closed at $110.03, down 0.6 percent from Wednesday.
The ANP said the oil was seeping out of cracks in the ocean floor, not the Chevron well that was sealed following last year's leak. Williamson, the Chevron executive, said there was no evidence that the new leak was caused by drilling or production at the Frade field.
</br></br>
The leak was first spotted on March 4, and engineers found the source on March 13, Williamson said. Oil is leaking from an 800-meter-long crack on the sea floor, only a few millimeters wide, said Mauro Pagam, an installation engineer with Chevron.
</br></br>
"We were not drilling or injecting water in the area of the latest leak," Williamson said. "The information that we have now leads us to believe that this is not ours."
</br></br>
The Campos basin is known for natural leaks of oil - seepage that helped lead to the discovery of the petroleum region, responsible for 80 percent of Brazil's oil output.
</br></br>
There is no longer any oil on the surface and the spill did not result in a slick, only "small balls of oil" that have been broken up mechanically by boats, Pagam said. Only 5 liters of oil were collected during the cleanup.
The ANP said on Tuesday that Chevron could win back its drilling rights "within months" if it can convince Brazilian officials it understands exactly what caused the November leak.

WASHINGTON -- The seven members of President Barack Obama's National Oil Spill Commission are banding together to monitor and rate government and industry efforts to implement the safety recommendations they made in the aftermath of the 2010 BP disaster.

The newly created "Oil Spill Commission Action" plans to issue its first report card on the performance of Congress, the administration and industry timed to the second anniversary in April of the blowout of the Deepwater Horizon that led to the spill.

"The commissioners have become increasingly concerned that efforts to implement the recommendations are ebbing in spite of all that still needs to be done," said William  Reilly, co-chairman of the commission.
"We intend to do our best to ensure that the public and other stakeholders do not lose sight of the problems we identified and the actions needed to mitigate future spills like the Deepwater Horizon," said former Florida Gov. and Sen. Bob Graham, the commission's other co-chairman.

"If America is to have the safest operations in the fragile offshore environment, it's essential that our recommendations be implemented," said a third commissioner, Frances Beinecke, president of the Natural Resources Defense Council. CLEARWATER — Pinellas County still has a $3 million bone to pick with BP over the gulf oil spill in 2010.
</br></br>
It's the amount the county calculates was lost, mostly in unpaid taxes and fees.
</br></br>
The spill never reached Pinellas beaches, but the county says its damages also include $1,300 in nixed park shelter rentals and $50,000 in cancelled golf at Airco Golf Course — links that the county shuttered as a long-running money loser last year.
</br></br>
The county filed claims but so far hasn't been paid. The County Commission unanimously voted to hire attorneys Tuesday on a contingency-fee basis to study and pursue its claims against the oil giant. This firm is Colson Hicks Eidson of Coral Gables.
</br></br>
The attorneys will not be paid unless the county wins. If so, the lawyers will receive a 25 percent cut, and 5 percent more if there's an appeal.
</br></br>
"I'm not counting on the fact we're going to get a lot of this money. ... If we're going to get any of this money, it's going to be down the road," said Commissioner Neil Brickfield, who called signing up the lawyers a "calculated" risk.
</br></br>
The county says it lost: $2 million in Penny for Pinellas sales tax collections because people didn't come here and spend money, $672,000 in Pinellas' share of the standard sales tax, and $256,000 in the county's of the tax on hotel stays.
</br></br>
To date, the county has received $173,000 for coastal photos and other labor due to the spill.
</br></br>
The county also received $1.15 million for tourism promotion in a deal with the state, but the Tourist Development Council wanted $5 million more.
</br></br>
While the vote to hire was never in doubt, Commissioner Ken Welch questioned the size of the payout to lawyers. Commissioner Karen Seel questioned why the county didn't try to sign on with the multi-firm team that Florida Attorney General Pam Bondi hired this month.
</br></br>
But chief assistant county attorney Dennis Long said the lawyers' cut was standard for the type of works. The firm has a New Orleans office, the hub of the multi-district lawsuits filed over the oil spill.
</br></br>
One of its lawyers is on a steering committee for plaintiffs in claims that do not include government agencies. That committee and BP recently reached a $7.8 billion settlement for economic losses and medical problems for people and businesses.
</br></br>
The firm is familiar to the county because it represents Pinellas in its long-running fight with online travel companies over how much taxes they should pay, Long said.
</br></br>
